Amending to the Circular on granting licenses to credit institutions

The Vietnam Banks Association (VNBA) has just sent an official dispatch to the General Directors of member organizations asking for opinions on the draft Circular amending and supplementing a number of articles of the Circular regulating the dossiers and procedures for granting first-time licenses to commercial banks, foreign bank branches and foreign representative offices, and non-bank credit institutions.

According to Official Dispatch No. 3226/NHNN-ATHT dated April 26, 2025 of the State Bank of Vietnam on soliciting opinions on the Draft Circular amending and supplementing a number of articles of the Circulars regulating the dossiers and procedures for granting initial licenses to commercial banks, foreign bank branches and foreign representative offices, and non-bank credit institutions (Draft).

The State Bank said that it has been assigned to develop Circulars related to the approval of expected personnel, licensing of the establishment of Cooperative Banks, People's Credit Funds, Microfinance Institutions, Commercial Banks, Non-bank Credit Institutions, Foreign Bank Branches, Representative Offices in Vietnam of foreign credit institutions, and other foreign organizations with banking activities (TCTD) to implement the plan to reduce and simplify regulations and administrative procedures related to criminal records approved by the Prime Minister in Decision 498.

Therefore, the State Bank has drafted an amendment to the Circular on licensing, allowing individuals to use electronic criminal records on VNeID or submit an electronic copy instead of form No. 2 when carrying out administrative procedures.

Accordingly, the draft developed by the State Bank has 5 Articles, including: Article 1, amending and supplementing a number of articles of Circular No. 56/2024/TT-NHNN dated December 24, 2024 regulating the dossiers and procedures for granting first-time licenses to commercial banks, foreign bank branches, and foreign representative offices; Article 2, amending and supplementing a number of articles of Circular No. 57/2024/TT-NHNN dated December 24, 2024 regulating the dossiers and procedures for granting first-time licenses to non-bank credit institutions; Article 3, effective date; Article 4, implementation organization.
